Par ailleurs, l\u2019OSFM m\u00e8ne actuellement des travaux visant \u00e0 int\u00e9grer \u00e0 ses activit\u00e9s le Bureau du surintendant \u2013 Commission manitobaine des pensions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Mission de l\u2019OSFM :<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">L\u2019OSFM cherche \u00e0 am\u00e9liorer l\u2019avenir financier de l\u2019ensemble des Manitobains gr\u00e2ce \u00e0 une r\u00e9glementation adapt\u00e9e qui favorise l\u2019\u00e9quit\u00e9, l\u2019honn\u00eatet\u00e9 et la transparence dans les secteurs des services financiers, des pensions et de l\u2019immobilier au Manitoba.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Vision de l\u2019OSFM :<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Des secteurs des services financiers, des pensions et de l\u2019immobilier forts et \u00e9quitables avantageux pour les professionnels et la population en g\u00e9n\u00e9ral gr\u00e2ce au soutien de l\u2019OSFM.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Priorit\u00e9s pour les ann\u00e9es de 2022 \u00e0 2025<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dans un contexte marqu\u00e9 par les transformations, l\u2019OSFM se veut proactif afin d\u2019anticiper les d\u00e9fis et d\u2019y r\u00e9pondre. Pour atteindre cet objectif, l\u2019OSFM travaille de concert avec les organismes \u00e9quivalents dans les autres provinces et territoires, notamment par l\u2019entremise des instances suivantes : Autorit\u00e9s canadiennes en valeurs mobili\u00e8res (ACVM), Conseil canadien des responsables de la r\u00e9glementation d\u2019assurance (CCRRA), Organismes canadiens de r\u00e9glementation en assurance (OCRA), Autorit\u00e9s de r\u00e9glementation de courtage immobilier du Canada (ARCIC), Conseil canadien des autorit\u00e9s de r\u00e9glementation des courtiers hypoth\u00e9caires (CCARCH), Association canadienne des organismes de contr\u00f4le des r\u00e9gimes de retraite (ACOR), Association des superviseurs prudentiels des caisses (ASPC) et Association nationale des responsables de la conformit\u00e9 des r\u00e9gimes de retraite. Ses principaux d\u00e9fis sont les suivants :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><em>Adaptation aux transformations \u00e0 l\u2019\u00e9chelle mondiale<\/em><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Alors que les march\u00e9s mondiaux sont de plus en plus interconnect\u00e9s et que de nouveaux produits et services font leur apparition, entre autres les cryptomonnaies et les services financiers d\u00e9centralis\u00e9s, une r\u00e9ponse coordonn\u00e9e devient essentielle pour r\u00e9pondre aux nouvelles pr\u00e9occupations et faire face aux risques \u00e9mergents ou grandissants.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><em>Renforcement de la protection des investisseurs<\/em><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">L\u2019OSFM continue de renforcer la protection des investisseurs contre les pratiques frauduleuses, manipulatrices et trompeuses en am\u00e9liorant ses m\u00e9canismes de contr\u00f4le et d\u2019application des lois, en veillant au respect des exigences d\u2019information et d\u2019inscription et en sensibilisant les investisseurs.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><em>Traitement des enjeux \u00e0 l\u2019\u00e9chelle locale<\/em><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">La plupart des march\u00e9s que l\u2019OSFM supervise ont une port\u00e9e nationale ou internationale, mais tous comportent des \u00e9l\u00e9ments et des r\u00e9alit\u00e9s qui leur sont propres \u00e0 l\u2019\u00e9chelle locale. C\u2019est particuli\u00e8rement le cas des secteurs de l\u2019immobilier, des caisses populaires et credit unions, qui sont essentiellement ancr\u00e9s au Manitoba. L\u2019OSFM accorde donc une attention particuli\u00e8re aux pr\u00e9occupations et enjeux locaux.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><em>Suivi des tendances \u00e9mergentes<\/em><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">L\u2019OSFM continue de suivre les tendances \u00e9mergentes dans les secteurs qu\u2019il r\u00e9glemente.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pour relever ces d\u00e9fis, l\u2019OSFM a d\u00e9fini quatre objectifs strat\u00e9giques \u00e0 atteindre entre 2022 et 2025 :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Renforcer la protection des investisseurs et des consommateurs<\/li>\n\n\n\n<li>Renforcer le cadre de r\u00e9glementation;<\/li>\n\n\n\n<li>Poursuivre les efforts d\u2019harmonisation du cadre de r\u00e9glementation avec celui des autres provinces et territoires, le cas \u00e9ch\u00e9ant;<\/li>\n\n\n\n<li>Am\u00e9liorer l\u2019efficacit\u00e9 des mesures mises class=\"wp-block-paragraph\"><strong><em>Contexte<\/em><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">L\u2019un des volets importants du mandat de l\u2019OSFM consiste \u00e0 informer les consommateurs et les investisseurs et \u00e0 les sensibiliser aux questions li\u00e9es aux secteurs relevant de sa r\u00e9glementation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>Mesures<\/em><\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Continuer \u00e0 enrichir et \u00e0 mettre \u00e0 jour les programmes \u00e9ducatifs destin\u00e9s aux consommateurs et aux investisseurs, en mettant l\u2019accent sur les tendances \u00e9mergentes des march\u00e9s financiers, la fraude et les pratiques abusives en mati\u00e8re financi\u00e8re.<\/li>\n\n\n\n<li>Renforcer les relations existantes et multiplier les occasions de collaboration avec des organismes externes afin d\u2019\u00e9largir la port\u00e9e des initiatives de sensibilisation du public, notamment aupr\u00e8s des communaut\u00e9s autochtones et des nouveaux arrivants au Canada, que ce soit par des activit\u00e9s \u00e9ducatives ponctuelles ou des class=\"wp-block-paragraph\">Lorsqu\u2019un probl\u00e8me survient relativement aux produits ou services fournis par un interm\u00e9diaire financier, il est important que les pr\u00e9occupations du client soient prises en compte et r\u00e9gl\u00e9es de mani\u00e8re juste et raisonnable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>Mesures<\/em><\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Examiner le processus de traitement des plaintes utilis\u00e9 par le Conseil d\u2019assurance du Manitoba et le Bureau du surintendant \u2013 Commission manitobaine des pensions.<\/li>\n\n\n\n<li>Examiner la possibilit\u00e9 d\u2019instaurer des normes de conduite sur le march\u00e9 pour les caisses populaires et credit unions dans leurs interactions avec les services environment that requires a regulatory approach that is risk based and which minimizes overlap and duplication.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>Mesures<\/em><\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>complete the implementation of the updated oversight process for the credit union and caisses populaires system, including developing a compliance review program for Deposit Guarantee Corporation of Manitoba drawing on the existing compliance program for self regulatory organizations in the securities industry.<\/li>\n\n\n\n<li>develop a compliance review program for provincially regulated insurance companies drawing on the compliance program for Manitoba securities registrants.<\/li>\n\n\n\n<li>review and update the existing compliance review program for real estate and mortgage brokers drawing on the compliance program for Manitoba securities registrants.<\/li>\n\n\n\n<li>review the current compliance review program for pension plans drawing on the compliance program for Manitoba securities registrants and increase the frequency of pension plan reviews.<\/li>\n\n\n\n<li>update the existing Delegation and Protocol Agreement with the Insurance Council of Manitoba.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>Contexte<\/em><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">While the MFSA has distinct and separate areas of oversight, there are common issues and responsibilities that can draw on expertise developed by other groups within the MFSA.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>Action<\/em><\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>investigate opportunities for increased collaboration between the investigation, real estate compliance, pension plan regulation and securities compliance areas.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>Contexte<\/em><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The current&nbsp;<em>Loi sur les contrats \u00e0 terme de marchandises&nbsp;<\/em>was originally enacted in 1996 and has not been reviewed and updated since then to reflect subsequent developments.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>Action<\/em><\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>conduct a review of\u00a0<em>Loi sur les contrats \u00e0 terme de marchandises (Manitoba)\u00a0<\/em>with regard to the legislation in other Canadian jurisdictions with a view to putting forward a proposal to the government for legislation updating or replacing the current statute.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>Contexte<\/em><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ontario and Saskatchewan have adopted legislation regulating the use of the \u201cfinancial planner\u201d and \u201cfinancial advisor\u201d titles and other jurisdictions are considering doing so.&nbsp; Submissions have been made to the government to do so in Manitoba as well.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>Action<\/em><\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>monitor developments on the adoption of financial planners title protection legislation in other Canadian jurisdictions with a view to consulting on the advisability of adopting it in Manitoba.<\/li>\n<\/ul>\n\n\n\n<ol start=\"3\" class=\"wp-block-list\">\n<li><strong>Continued regulatory consultation and harmonization with other jurisdictions<\/strong><\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>Contexte<\/em><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Commission operates in most areas on a harmonized basis with other provincial and territorial jurisdictions through the CSA.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>Mesures<\/em><\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>continue to contribute to key CSA projects, including the environmental, social and governance initiative regarding climate change disclosure, expanded disclosure regarding diversity, liquidity risk management in investment funds and the modernization of the continuous disclosure regime.<\/li>\n\n\n\n<li>continue to lead the CSA initiative regarding client facing registrant titles.<\/li>\n\n\n\n<li>continue to actively participate in the CSA sandbox committee and the CSA cryptocurrency task force.<\/li>\n\n\n\n<li>continue its full participation in the CSA\u2019s self regulatory organization consolidation project.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>Contexte<\/em><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Financial Institutions Regulation Branch, the Real Estate area and the Office of the Superintendent- Pension Commission participate in national organizations that provide a forum for discussing issues of common interest and sharing information.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>Action<\/em><\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>continue the MFSA\u2019s participation in CCIR, CISRO, REAC, MBRCC, CAPSA, CUPSA and NPCOA.<\/li>\n<\/ul>\n\n\n\n<ol start=\"4\" class=\"wp-block-list\">\n<li><strong>Carry out MFSA\u2019s operations in a more efficient and responsive manner<\/strong><\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>Contexte<\/em><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is important that the MFSA continue to identify opportunities to conduct its operations in a more effective manner that is responsive to the industries it regulates and to the public.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>Mesures<\/em><\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>implement the local aspects of SEDAR+, including updating the Poller system and any other interfaces.<\/li>\n\n\n\n<li>update the Manitoba Securities Commission prehearing policy and consider adopting it as a formal Commission rule.<\/li>\n\n\n\n<li>obtain and implement case management software to manage the investigation and enforcement process from receiving the initial complaint through the completion of any resulting hearings.<\/li>\n\n\n\n<li>establish monitoring process for progress of investigations and hearings and adopt targets for the initiation and completion of enforcement proceedings.<\/li>\n\n\n\n<li>establish benchmarks for conducting compliance reviews and a process for monitoring the progress and completion of these reviews.<\/li>\n\n\n\n<li>complete the project to install technology to facilitate conducting hearings through electronic means.<\/li>\n\n\n\n<li>complete the project to install video taping technology for conducting interviews in investigations.<\/li>\n\n\n\n<li>review and assess the capabilities of the Pension Benefits Information System and its ability to meet all current and future requirements.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>Contexte<\/em><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The MFSA\u2019s mandate has recently been expanded to include the administration of the Pension Benefits Act.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>Action<\/em><\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>integrate the Office of the Superintendent- Pension Commission and its personnel into the MFSA.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>Contexte<\/em><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">MFSA personnel interact with the public, industry, other regulators and government officials on an ongoing basis and have an obligation to do so on a responsive and professional basis.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>Action<\/em><\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>establish standards for responses by staff to inquiries from industry and the public.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>Contexte<\/em><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The MFSA does not have unlimited resources and changes in staffing in individual areas occurs on a regular basis, due to resignations or retirements and it is important that it be able to carry on its operations despite these changes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>Mesures<\/em><\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>establish succession plans for all areas.<\/li>\n\n\n\n<li>document policies and procedures for each area for their operations.<\/li>\n\n\n\n<li>pursue cross training opportunities across MFSA.<\/li>\n\n\n\n<li>identify and encourage educational opportunities on the part of MFSA staff.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>Contexte<\/em><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">MFSA staff receive inquiries from industry and the public through emails and telephone calls that often cover similar topics or which may indicate trends.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>Action<\/em><\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>investigate methods to track inquiries across the MFSA, including examining whether the existing Pension Commission system is a potential solution.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>Contexte<\/em><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The MFSA\u2019s website is the primary means by which it
